The building permit: the steps and documents you need

The building permit is the act by which the competent public authority allows construction works to be carried out, under Law no. 50/1991 on the authorisation of construction works. Under art. 4 of that law, permits are issued by the presidents of county councils, by the General Mayor of Bucharest, or by mayors, as the case may be, and a permit cannot be obtained without complete technical documentation prepared by designers holding the right to sign. Knowing the legal framework from the start helps establish a sound path with no unnecessary detours.

The first document in the process is the urbanism certificate. It does not authorise the works; rather, it communicates the legal, economic and technical status of the land and, crucially, the list of approvals and consents required. It also indicates whether a zonal urban plan or other preliminary studies are needed. In practice, the urbanism certificate is the map that shows what must be secured before submitting the permit application.

Based on the certificate, the required approvals and consents are obtained, from utility connections to environmental, health, fire-safety and other institutional approvals, depending on the type and location of the investment. In parallel, the technical documentation for authorising the works is prepared, comprising the architecture, structure and building-services sections, accompanied by the applicable specialist studies, such as the geotechnical survey and the topographic survey.

The complete file, application, documents proving the right over the land, a valid urbanism certificate, the approvals obtained and the verified technical documentation, is submitted to the issuing authority. The legal deadline for issuing the permit starts to run from the submission of a complete file; incomplete documentation leads to requests for additions that prolong the process. This is why the order of the steps and careful checking of the file matter more than they might seem.

Once issued, the permit has a validity period set by law and requires that the start of works be announced. For the client, the essential message is that permitting is not a mere closing formality but a stage built up gradually, in alignment with the requirements of the approving authorities. A properly coordinated project moves through this stage smoothly, without surprises caused by missing approvals or inconsistencies between disciplines.
